美国国税局裁员给房地产预扣税退税申请人敲响警钟

Brooks (税务律师/DIRECTS董事长) 和Angela Li (MBA) 2025年2月,美国国税局(IRS)裁撤了大约7,000名员工(主要为近期新聘人员),裁员后IRS现有约90,000名员工。然而,根据2025年5月的多家新闻报道,IRS即将启动规模更大的裁员。据美联社(Associated Press)报道,IRS正在起草计划,通过裁员、自然流失和激励性买断相结合的方式,将其员工人数削减至一半。裁员幅度若真达到50%,即从90,000人缩减至45,000人,将对现行依赖人工操作的预扣税退税流程造成严重影响并显著放缓退税时间。我们对此来展开分析。 当前系统严重依赖人工操作 IRS目前采用的退税流程极其陈旧,依赖人工将非美国纳税人提交的预扣税支票(通常是大额的)与相应预扣税文件进行核对。这些文件和预扣税支票通常是在报税年度之前提交的,有时甚至在报税人提交税表的两年前就已提交至IRS。当前房地产预扣税的退税流程完全依赖于国税局工作人员的实效性。工作人员的减少给本来已经缓慢的退税过程带来更大的挑战。更关键的是,外国房地产交易的退税金额非常巨大— 并非类似一般美国1040退税中常见的类似1,500美元退税金额,外国售房者在出售美国房地产后通常可退回数万甚至数十万美元的预扣税款(有时可高达数百万美元)。当IRS员工人数骤减至一半时,这些大额退税怎么办呢? 联系IRS国税局工作人员查询退税进度有多困难? 您一直拿不回预扣税怎么办?您(或代表您处理报税事宜的税务公司如DIRECTS)通常需要打电话与IRS工作人员查询退税进度。但想电话联系到国税局工作人员并非易事:您可能需要等待长时间的电话排队,有时甚至需要等待2至3小时才能接通,某些情况下甚至可能需要等待数日才能联系到国税局工作人员 。这种情况在国税局大规模裁员后只会更加严峻。 即便最终接通电话,接线人员是否具备足够的外国房地产预扣税退税知识也是未知数。即使该工作人员对外国人退税过程了解,他们能提供的帮助也极为有限,通常仅限于以下几种回复: 通知您:退税申请正在处理; 通知您:税表目前处于审查阶段; 告知您:尚缺少某些关键资料,导致无法处理退税。 如果您需要补交文件,是否可以通过电话直接提交?也许可以,但多数情况下需要通过传真提交,甚至可能需要邮寄,这无疑进一步增加了不确定性和时间成本。 总而言之,拨打国税局电话查询退税进度是一项极具挑战的任务。如果未来国税局员工减至当前的一半,联系工作人员可能变得近乎不可能——或许以后拨打国税局电话需等待5小时以上,甚至需依赖系统回拨服务等待数日才能获得回复。 当前房地产预扣税退税流程为何如此繁琐? 国税局当前使用的退税系统部分仍基于上世纪60年代的技术和流程,数十年来未有实质性改革。造成流程复杂的原因主要有以下几点: 身份识别困难 多数外国卖家在房产交易成交之日并未拥有美国社会安全号码(SSN)或美国纳税人税号(ITIN)。他们通常只能在成交后申请税号/ITIN,而无法预先申请。因此,15%的预扣税(按成交总价计算)常常在没有纳税人税号的情况下直接缴入IRS国税局系统,难以与具体纳税人账户进行匹配。 IRS接收预扣税困难 国税局在确认其是否收到预扣税方面效率很低。我们曾多次致电IRS,与其工作人员反复核对支票的相关信息(该支票已被IRS兑现),但工作人员依然无法在系统中“找到”这张支票。这种情况令人难以置信。 预扣税款与外国卖房者账户关联困难 即使IRS承认已收到税款,下一步还需将其与具体外国卖家的账户建立关联,这一过程也常常出现问题——即便该外国卖家拥有税号,也未必能顺利完成匹配。 其他复杂因素 身份验证流程的日趋严格,可能导致退税进一步延迟; 税表本身可能被选中审计(audit); 国际邮件的安全问题日益突出,退税支票频繁丢失或遭窃。 因此,即使一切顺利,退税流程也可能耗自提交后一年甚至更久;当然在极为顺利的情况下也可能仅需几周时间。这是在现有9万员工情况下的效率。 展望未来:人员减半后,退税将变得更加复杂与漫长 目前的退税流程高度依赖人力处理,本身已经是一个复杂、落后且易出错的系统。在这样的基础上大规模削减人员,无疑将导致退税申请难上加难。我们实在难以理解,在如此依赖人工、平均退税周期已达一年之久的体系下,如果IRS员工人数减半,这一流程如何还能运作得下去。 DIRECTS每年为来自全球近千名的外国售房者成功退回大额预扣税,这是我们唯一业务,尤其擅长办理各种复杂情况下的大额退税,我们随时关注政府的最新情况并调整策略已便成功帮助外国售房者拿回大额退税。
