作者:Michael Brooks 美国政府已经关门停摆超过一个月,这意味着在2025年10月期间,许多联邦政府雇员都没有上班。然而,仍有部分联邦政府雇员在过去一个月中继续工作(尽管他们没有工资),因为他们被认定为“关键人员”(essential workers),因此即使在关门停摆期间无论是否发薪,也必须继续工作。那么,美国财政部下属的国税局在这种情况下处于什么位置?您现在是否可以致电国税局查询退税进度?在关门停摆期间,国税局是否仍在处理退税?是否仍在处理ITIN(美国纳税人身份号)?在关门停摆期间,国税局是否仍在接收并处理外国卖主缴纳的卖房预扣税款和预扣税文件8288与8288-A?请注意,预扣税文件及相应的预扣税款必须在交易完成后20天内提交给国税局,否则可能面临巨额罚款。因此,即使在政府关门停摆期间,理论上仍应该有国税局工作人员在接收并处理这些预扣税文件与预扣税款,对吗?这些问题难以给出确定的答案。根据我们DIRECTS公司专门为外国售房者申请预扣税退税的多年经验,我们回顾一下2025年10月期间(美国历史上最长联邦政府关门停摆的首月)外国售房者的预扣税退税的相关情况。 目前可以致电国税局查询退税状态吗? 您可能会惊讶地发现,在2025年10月期间,国税局仍然有工作人员接听电话。您(或我们代表您)致电国税局可能需要等待很长时间(通常超过一小时,甚至两小时),有时电话自动语音会提示当前来电过多、无法接通,但总体而言,即使在政府关门停摆期间,国税局在10月份仍有人在接听电话。这意味着部分国税局员工仍在工作!需要注意的是,您电话中接触到的国税局工作人员通常只是提供退税状态更新的客服人员,而非实际处理退税的工作人员。他们只能告知您的预扣税退税进度,并在退税延迟时告知原因(例如是否需要补充文件)。在之前2018年政府关门停摆事件期间,我们记得国税局电话系统完全无人接听;在2020年新冠疫情期间,国税局也曾长时间停工。但截至目在2025年10月的政府关门停摆期间,情况并非如此。只要您有耐心, 并且(至少目前)只想通过国税局工作人员了解您的退税进度,我们确实已在10月份成功帮助一些外国客户联系了国税局,并获取了外国客户退税状态的最新进展。 国税局在2025年10月关门停摆期间是否真的仍在处理退税? 令人意外的是,答案似乎是肯定的——我们确实有外国客户在2025年10月期间收到了退税。这些退税申请是否在10月前已被批准,仅在10月发放?这点无法确定。但根据部分外国客户在10月下旬才收到退税的事实来看,似乎在关门停摆期间仍有部分退税处理在进行。当然,退税处理的速度与数量明显不如关门停摆前。我们相信大部门国税局退税处理人员在停摆期间未上班。我们也有若干外国客户的退税明显延迟(部分外国客户已等待相当长时间),这些复杂或延误的案例在10月并未得到解决。因此,国税局当前的退税处理效率明显低于关门停摆前。不过,至少对于我们的非美国客户而言(DIRECTS的客户全部为外国售房者),国税局在关门停摆期间仍在处理部分退税,使得此次关门停摆在目前看来,比以往的政府关门停摆情况略为乐观。 国税局在停摆期间是否仍在处理ITIN(美国纳税人身份号)? 可以看出一个趋势——答案再次是肯定的。我们有客户在2025年10月获得了ITIN,这表明位于德克萨斯州奥斯汀的国税局办公室(负责ITIN处理)仍在运行部分业务。当然,ITIN的处理速度远不及正常水平,但至少并未完全停摆。部分处理总比完全停滞要好,不过可以确定处理进度有所放缓。 国税局是否仍在接收并处理售房预扣税文件8288及8288-A和售房预扣税款? 截至目前,我们未发现任何迹象显示国税局在2025年10月停摆期间停止处理这些预扣税文件与预扣税款。Escrow/产权过户公司仍继续通过美国邮政系统寄送预扣税款(尽管2025年3月的行政命令已要求国税局以电子形式接收预扣税款)。但从我们掌握的情况来看,国税局仍接受通过邮寄方式的预扣税款的提交。 总结 尽管美国政府关门停摆带来了诸多负面影响,但根据我们DIRECTS在2025年10月的经验,国税局仍在有限程度上继续处理部分预扣税退税。如果关门停摆持续至2025年11月,这种有限程度的处理外国售房者的退税服务是否还能继续下去?我们目前尚不得而知。
